LyFEL reserves the right to modify these terms and conditions of use and sale at its discretion. LyFEL will inform each user of its sites by email at the address provided on the user’s account of any modification to these terms and conditions of use and sale at least 15 (fifteen) days before they take effect. In the event that the user does not accept these modifications, they are free to stop using the sites from their account. Otherwise, the new terms and conditions of use and sale will apply.

General terms of use

Article 1: Definition

LyFEL, a business activity of the company MOLIÈRE CONNEXION registered with the RCS Mont de Marsan under the number 981 344 237, with its registered office at 160 Rue des Bruyères, 40160 Gastes, provides private general and extracurricular school education services, distance learning courses, distance learning supplementary education, and the organization of French international sections at a distance on behalf of partner institutions, and more generally, any teaching service. The courses are taught by the salaried teaching teams of the company. The term « customer » for the company includes the student and their legal guardians and/or parents, as well as the partner institutions.

The websites covered by the following Terms and Conditions are all the sites of the LyFEL company, its subsidiaries, its parent company, its sister companies, and notably the site: https://www.lyfel.org

To register on the sites, every user must first create a personal account and unconditionally accept these terms and conditions of the sites during registration. Access to the various services of the sites is strictly subject to the unconditional acceptance and compliance with these terms and conditions by any user.

The use of the sites is authorized only within the family circle: thus, any use outside of this scope, especially for public use or public dissemination, is strictly prohibited.

Users and customers of the sites are solely responsible for the messages, content, and information published by them on the sites since, in its capacity as the host of the service in question, within the meaning of the provisions of the law n° 2004-575 of June 21, 2004, for confidence in the digital economy, LyFEL cannot be held responsible for the content published by users and customers on the sites over which LyFEL has no control and surveillance powers.

LyFEL reserves the right to evolve its services or the Site, including by providing new features or by modifying and/or deleting features that are currently offered to the member from the Site.

Article 2: Prices and Payment Terms

The prices indicated are in euros. Prices are firm and final, valid for the indicated school year. Unless otherwise specified, payment is due in full at registration. No registration can be validated without payment. In case of the impossibility to provide the planned courses, the company undertakes to refund the amounts previously paid. The accepted means of payment are credit card and bank transfer. It is reminded that connection and communication (Internet) fees related to the use of LyFEL sites are not covered by LyFEL and remain the responsibility of the customer/user.

Article 3: Insurance and Liability

The services of the company are covered by professional liability insurance. The user of the sites declares to be aware of the constraints and limits of the Internet networks. LyFEL cannot be held responsible in any case for malfunctions in accessing the proposed services, the speeds of opening and consulting the pages of the services, the speeds of listening to the recordings, the temporary or permanent inaccessibility of its services, fraudulent use by third parties of the information made available on the sites. Consequently, it is the responsibility of the user to protect their computer equipment or other, especially against any form of intrusion or contamination by viruses: LyFEL cannot be held responsible for this. In general, LyFEL disclaims all liability if a breach of any obligation is due to a case of force majeure or fortuitous event, including, but not limited to, disasters, fires, internal or external strikes, internal or external failures or breakdowns, and in general any irresistible and unforeseeable event preventing the proper execution of orders.

In no event shall LyFEL be liable in the event that the proposed service proves to be incompatible with certain equipment or functionalities of the user’s computer hardware.

Article 4: CNIL (French Data Protection Authority)

The information collected is subject to computer processing intended to manage LyFEL’s commercial relations. The recipients of the data are subcontractors, business partners, and the teaching teams.

The customer authorizes LyFEL to send them emails and SMS. The failure to pay for the services results in registration on the debtor client exclusion file. In accordance with the « Informatique et Libertés » law of January 6, 1978, as amended in 2004, the customer has the right to access and rectify the information concerning them, which they can exercise by contacting the General Management – Data Protection Officer – LyFEL, 160 Rue des Bruyères – 40160 Gastes or by email at contact@lyfel.org. The customer may also, for legitimate reasons, object to the processing of data concerning them. The customer can object to any recording of telephone conversations with their interlocutor by informing them in advance.

Article 5: Intellectual Property

The general structure of the sites and all other elements composing them (such as recordings, graphic charts, texts, including comments, visuals, photographs, logos, domain names, associated elements including photographs, images, texts, and biographies of authors, performing artists, and/or any other rights holder of the recordings, as well as the visuals of the packaging of the recordings and the biographies) are the exclusive property of LyFEL or its licensors (including phonographic and/or videographic producers (‘record companies’), collective management society for copyright (such as SACEM), etc.), or have been subject to prior authorization for use for the benefit of LyFEL.

The user may only use these elements within the framework of the use of the services offered by LyFEL, in accordance with the provisions of these general terms and conditions of use and sale.

Any reproduction and representation, in whole or in part, of the sites and/or the elements composing them, including the documents offered for sale, by any means whatsoever, without the express written authorization of LyFEL is prohibited and would constitute infringement punishable by articles L. 335-2 and following of the Intellectual Property Code.

Any other use of the digital files offered by the sites is strictly prohibited, any burning or attempt to burn to a CD or any other support is expressly prohibited. Any resale, exchange, or rental of these digital files is strictly prohibited.

Article 6: Personal Data

LyFEL undertakes to comply with current legislation regarding the protection of privacy with regard to the automated processing of personal data.

The information and data collected concerning the user are subject to computer processing and are mandatory because they are necessary for the management of their registration. For this purpose, they may be transmitted to companies responsible for the management, execution, and processing of payment operations. These pieces of information and data are also kept for security purposes, to comply with the legal and regulatory obligations to which LyFEL is subject. These data are processed and stored by the host of the sites identified in the legal notices on the sites under conditions to ensure their security.

If the user has consented, the collected data may also be used in the context of the management of our commercial relations to establish statistics and also allow LyFEL to improve and customize the services it offers and the information it sends them.

In accordance with the French « Informatique et Libertés » law n°78-17 of January 6, 1978, the user has the right to access and rectify the information concerning them. If they wish to exercise this right and obtain communication of the information concerning them, the user is invited to contact LyFEL via the address contact@lyfel.org.

If the user has consented (for example, when creating an account to register), the user may receive the newsletter from LyFEL at their email address as provided and, if necessary, modified by them. If the user no longer wishes to receive this newsletter, they can unsubscribe at any time by clicking on the link provided for this purpose at the bottom of each newsletter or by modifying the data concerning them from their account. If the user has consented, they may receive offers from LyFEL partners at their email address as provided and, if necessary, modified by them, and their contact details may be transferred to business partners.

The user is informed that data concerning them may be disclosed in application of a law, regulation, or pursuant to a decision of a competent regulatory or judicial authority or, if necessary for LyFEL, as part of legal proceedings.

Article 7: Applicable Law and Dispute

These general terms and conditions of use and sale are subject to French law. In the event of a dispute, the parties will seek an amicable solution before any legal action. In the event of failure of these attempts, any disputes over the validity, interpretation, and/or execution of these general terms and conditions of use and sale must be brought, even in the case of multiple defendants or recourse, before the French courts.

In the event that any provision of these general terms and conditions of use and sale is declared invalid or unenforceable for any reason, the other provisions shall remain applicable without change.

Any dispute that may arise between the parties as to the validity, interpretation, or execution of these terms and conditions shall be submitted to the competent courts at the registered office of the LyFEL company.
